Terms of Service
Introduction
These Terms of Service (“Terms”) govern your access to and use of the Gorby website at https://gorby.app/ and related services (collectively, the “Service”) operated by Gorby (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Eligibility
You must be at least 16 years old to use the Service. By using it, you represent that you meet this requirement and that all information you provide is accurate and truthful.
Accounts
- Registration: To access certain features you must create an account using a valid email address and a password.
- Account Security: You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at contact@gorby.app if you suspect unauthorized access.
- One Account: You may not create multiple accounts to circumvent any restrictions or limitations we apply.
Purchases and Payments
Gorby offers both one-time purchases (delivered as a license key) and subscription plans, depending on the current offering. Paid features are available only after a valid purchase or an active subscription.
- One-Time Purchases: When you buy a lifetime or yearly plan as a one-time purchase, you receive a license key that you redeem to unlock paid features. License keys are tied to your account and may not be transferred or resold.
- Subscriptions: If you purchase a recurring subscription plan, you authorize us (through our third-party payment processor) to charge your chosen payment method on a recurring basis. Subscriptions renew automatically unless you cancel before the renewal date. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.
- Refunds — Standard: You may request a full refund within 14 days of purchase by contacting us at contact@gorby.app. This is in line with EU consumer protection law.
- Refunds — Partial: For yearly and lifetime purchases, if you request a refund between 14 and 30 days after purchase, we may issue a 50% partial refund at our discretion.
- Price Changes: We may update our prices at any time. We will give you reasonable advance notice before any increase takes effect. Continued use of the Service after that date constitutes acceptance of the new price.
Acceptable Use
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. You must not:
- Attempt to gain unauthorized access to any part of the Service or its underlying systems.
- Reverse-engineer, decompile, or disassemble any software component of the Service.
- Resell or sublicense access to the Service without our written permission.
Intellectual Property
- Our Content: All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and icons — are owned by or licensed to us and are protected by applicable intellectual property laws.
- Your Content: You retain ownership of any text or content you enter into the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide the Service to you. We do not use your content for any other purpose.
- Local Processing: All text analysis in the Gorby application is performed locally on your device. Your documents are never transmitted to or stored on our servers. The only exception is the optional AI feature: when you explicitly invoke an AI analysis on a selected piece of text, that text is sent to Google Gemini via OpenRouter solely to generate the response. It is not retained, logged, or used for training by us or our providers.
Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
Third-Party Services
The Service integrates with third-party providers for functions such as payment processing and analytics. These providers are governed by their own terms and privacy policies. We are not responsible for the acts or omissions of any third-party providers.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Any reliance you place on the Service is strictly at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Gorby and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or €50, whichever is greater.
Some jurisdictions do not allow limitations on liability, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Gorby and its affiliates from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
Termination
- By You: You may stop using the Service and delete your account at any time.
- By Us: We may suspend or terminate your access immediately, without prior notice, if you violate these Terms or if we reasonably believe your use harms the Service or other users. Upon termination, your right to use the Service ceases immediately.
- Effect of Termination: Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — shall survive.
Changes to These Terms
We may revise these Terms at any time. When we do, we will update the “Last Updated” date at the bottom of this page. If changes are material, we will notify you by email or by a prominent notice on the Service. Continued use of the Service after the effective date of revised Terms constitutes your acceptance.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Serbia.
